Law and Justice in Chimor

Although several nations have the opinion that Chimorese justice is biased and influenced by communism, the outside world is generally positive. Chimor doesn't appear on the blacklist of Amnesty International. In the past, Chimor was often condemned by the United States for having a law system that was heavily influenced by ataxunism. In response, Chimor condemned the "barbaric" death penalty in the USA, something that "civilized nations like Chimor didn't need".

The Chimorese legal system didn’t really change after the Ataxunist coup in 1990. Chimor took over most of the existing legal system of the colonial period. Experts therefore consider Chimor’s legal system as a system in the tradition of Spanish law, although certain changes have been made. The law system includes the National Court (this is the highest court, the Tribunal Supremo), the Provincial Court (Tribunal Provincial), the municipal court (Tribunal Municipal) and the local court (Tribunal Local, mostly at neighbourhood level, or in the countryside at village level).

The Tribunal Local is special. It is a more or less informal court where minor crimes are tried by neighbourhood- or village-councils. These councils are mostly occupied by commonly respected people, who often know the perpetrators personally. Penalties are usually low, and often they are settled amicably. Penalties often consist of service duties. This form of local justice highly appeals to the community and to the responsibility of the perpetrator. In general this works excellent. Partly because of this law system, there are relatively few minor crimes in Chimor. Another reason for this is the visible presence of police and army on the streets.

Chimorese Law sticks to the principle that everyone is innocent until guilt is proved. The legal system makes use of trial by jury. The jury always consists of people who are independent.

Advocacy

Legal assistance is free in Chimor. Unlike capitalist countries, rich or influential clients have no advantage over ordinary clients, simply by hiring the best lawyers. Chimorese lawyers are divided into different classes based on their qualities. They are only paid by the state. For each trial, an independent commission determines the class of the lawyer, who will always be in the same class as the counterparty. Lawyers are paid by performance to some extent.
